A DE judge on Wednesday told Uber investor Benchmark that its dispute with fellow Uber board member and former CEO Kalanick should be handled in private arbitration.

Uber Technologies Inc's [UBER.UL] new Chief Executive Dara Khosrowshahi told employees on Wednesday the ride-services company would change its culture and may go public in 18 to 36 months.

At an all-hands meeting at Uber HQ in San Francisco this morning, former CEO Travis Kalanick was reportedly crying as new CEO Dara Khosrowshahi (pronounced cause-row-SHA-hee) was introduced to the company.

They're then lined up in front of a plane with the name of her new album, Reputation , spray painted across it. It was released the same week as a music video from Katy Perry .

Khosrowshahi arrives at the trouble company at a time when a number of key staff posts at the very top remain vacant following a string of controversies at the heavily funded company.

Mr. Kalanick responded on August 18 with a motion to dismiss the case or move it to arbitration, where he can avoid being forced to go on the record. Lawyers for Kalanick and Benchmark, one of Uber's major investors, met for the first time in court Wednesday to hash out an explosive lawsuit.

The board had already selected Khosrowshahi as Uber's next CEO in a vote on Sunday, two sources told Reuters.

The embattled ride-hailing startup has been without a CEO since founder and former CEO Travis Kalanick resigned in June after an investigation into the company's culture. He was off the Uber board within hours, and it became the unfortunate Uber meme for a while.

Although Khosrowshahi, 48, called his new job "the opportunity of a lifetime" in an interview with Bloomberg, he's facing a long list of challenges. Uber now has vacancies for several key positions including a CFO (officially), chief operating officer, chief marketing officer, general counsel and senior vice president of engineering.

Benchmark argued the opposite, telling Glasscock that allowing Kalanick to fill the seats "and act as the decisive board vote would seriously damage Uber and its stockholders". But whether he makes the move to Uber or not, Expedia is on track to increase gross bookings by another $30 million in three years.
