DA McMahon speaks out against concealed-carry legislation

The bill faces strong opposition from Democrats as it moves into the Senate, but if it passes, it would essentially accomplish the main goals of the Small Business and Transportation Coalition's "Mike's Law". It turns out his read on the bill is misleading.

Additionally, the bill specifies that a qualified individual who lawfully carries or possesses a concealed handgun in another state: (1) is not subject to the federal prohibition on possessing a firearm in a school zone, and (2) may carry or possess the concealed handgun in federally owned lands that are open to the public.

Traditionally, states have decided for themselves whether to honor out-of-state permits, a legal concept known as "reciprocity".

Both parties have said that they hope the matter will be resolved soon, but neither looks likely to budge. That includes Amazon Fire tablets, as Google hasn't threatened to block those yet.

While the bill would seem to undermine the authority of each state, supporters argue that the Full Faith and Credit clause of the Constitution should afford concealed carry permits the same nationwide recognition as driver's licenses.

And according to Boyle, the Republican measure would supersede state and local laws concerning the carry of concealed weapons in school zones.

Democrats also criticized Republicans for including a bill on background checks in the concealed-carry legislation.

Guns can not be carried in New Jersey.

Although permits are not required in Kansas, the state does issue some concealed-carry permits for bodyguards and others who now must take guns across state lines, or who want proof of their qualifications for business purposes.

So under the Gun-Free School Zones Act, a permit issued by State A would allow you to legally carry in a school zone located in State A, but not a school zone in State B, Kopel said.
